This privacy policy (“Privacy Policy”) is in the context of and to govern the access and usage of the “GatiShakti Sanchar Portal” (GSS portal), an initiative of Department of Telecommunications, Ministry of Communications, Government of India. This Privacy Policy describes and determines how GSS portal (referred to as DoT or MoC or BISAG-N, We/Us or Our or GSS portal), handle and/ or deal with your (referred to as You or Your or User or digger or asset owner) personal and usage information, in accordance with the applicable laws of India (hereinafter collectively referred to as “Personal Information”).

“GatiShakti Sanchar Portal” is a collaborative institutional mechanism between all stakeholders including Central and State/UT Government(s), Local bodies, and Service Providers to facilitate the Right of Way (RoW) Application Process through a single interface.

This portal envisages bringing transparency, accountability and responsiveness to all stakeholders while processing the application. This has further been taking a giant leapfrogging towards “Ease of Doing Business” as the application process for installation of Digital Infrastructure is being delayed due to inconsistency and uncertainty of policy and process and it requires maintaining a fast-tracking application process to overcome the challenges of implementation of Right of Way Rules-2016. This would provide a robust mechanism to achieve our goal of “Broadband to All” as envisaged in the National Digital Communication Policy-2018.

GatiShakti Sanchar Portal will enable applicants from Telecom Services Providers (TSPs), Infrastructure Providers (IPs), Internet Services Providers (ISPs) etc. to apply for RoW approvals for laying Optical Fiber Cables (OFC) and erecting Telecom infrastructures like Towers etc. to submit their applications to various agencies of State/UT Governments and local bodies. For effective monitoring the dashboard of the portal gives pendency status including average time disposal – overall, State wise and district-wise.

This Privacy Policy inter alia determines and explains:

1. What all types of information are collected from you?
   • Your personal, demographic, location, device, agency details and other similar information may be collected. The information collected by us shall depend on that you are an employee of TSPs registered on GSS portal and undertaking configured on Website may vary from time to time which will be informed through changes in this policy.
   • Completing your profile shall help us provide you better user experience such as pre-filling the forms with available information (which can be edited), providing information of registered applicants on GSS portal based on your information, providing application details of TSPs/ applicants for RoW permissions to the Approving Authorities.
   • Your usage details may be used for the necessary analytics/dashboard design, purpose, to enhance your experience such as recommendations reminders for activity due dates, reminders for responses by asset owners, etc based on application submission date, application approving date, and application reverted date.
2. How do we use Your Personal Information and/or collected usage data/statistics?
   • Your Personal Information shall help us to categorie the application status and to monitor the dashboard of the portal which gives pendency status including average time disposal – overall, State wise and district-wise.
   • Device and location information shall help us in adapting the content/display as per your device and/or recommending you for precautionary measures according to your digging location etc.
3. How do We handle/manage your Personal Information
   • All your personal information shall be stored in secured form and shall only be shared with the concerned Approving Authority of that respective States/UTs/TSPs/DoT LSAs/Business entity on the need basis for further coordination.
   • None of your Personal Information shall be shared with any other individual and/or any other parties without your express consent except that required by or under applicable laws.
   • Except for the purposes mentioned above, most of the collected Personal Information shall only be used for user categorization/classifications for the purposes of analytics.
4. Personal Information collected  may be used by GSS portal, inter alia, for:
   • Sending notifications about application status, details of plan, due dates etc.
   • Enhancing the efficiency/quality of services offered on GSS portal.
   • Resolving any disputes that may arise with respect to the enquiry made through the GSS portal.
   • Monitoring user activity and preferences as evidenced from user’s activity on GSS portal to provide a better experience in future
   • Detecting, investigating and preventing activities that may violate our policies or that may be illegal or unlawful.
   • Any purpose as may be required under applicable laws.

5. Personal information, agency information, digging plans etc. submitted and/or captured may be shared with law enforcement agencies and other Government departments if the Department of Telecommunications has a good faith/ belief that access, use, preservation or disclosure of the information is reasonably necessary to:
   • meet any applicable law, regulation, legal process or enforceable government request;
   • enforce applicable Terms of Service, including investigation of potential violations;

It will be a constant endeavor to protect the system from unauthorized access or unauthorized alterations, disclosure or destruction of information. In particular, all the information will be held in secured form. Further, mobile OTP based authentication has been deployed to ensure authenticity of the user. 

We collect, receive, possess, or store the Personal Information, to enable us to serve you effectively, and to enable us to provide more personalized and enhanced experience to you. If the terms of this Privacy Policy are not acceptable to you, please do not use GSS Portal and/ or the contacts or services provided through it.
